On 31 December 2020, the Hornsea Three Offshore Wind Farm Order 2020 was made by the Secretary of State for Business, Energy and Industrial Strategy (now named the Secretary of State for Energy Security and Net Zero). The Order came into force on 22 January 2021. Amongst other things, the Order authorises Orsted Hornsea Project Three (UK) Ltd (“Orsted") to exercise powers under the Order to acquire compulsorily new rights over land and imposition of restrictions.
Article 22 of the Order provides for the application, with modifications, of the Compulsory Purchase (Vesting Declarations) Act 1981 (“the Act”) to the Order. Notice of authorisation of compulsory acquisition was first published in accordance with section 134 of the Planning Act 2008 on 04 January 2021.
On 01 May 2026, Orsted executed a general vesting declaration under section 4 of the Act, as modified by the Order.
